Terminating lease prior to Trustee Sale in AZ?
We got notice a notice of trustee sale on the house we’re renting that it will go up for sale in December. We are concerned about getting our deposit back plus having the expense of a move. The landlord has let services slide due to non payment, but has said we can have them done and deduct it from the rent. There have been numerous issues of repairs going undone for months. Do we have cause to terminate so we can move into a stable home before the trustee sale? I don’t want to be dealing with this over the holidays with young children.
Arizona passed a law to protect renters in your position. You have the right to send a demand letter to the landlord. He must provide proof to you that he has the money available today to pay up all the back payments. If he does not provide that proof, you are released from certain responsibilities.
Too many renters were losing their rental security deposits to landlords who were collecting the rent but not paying their mortgage. After the foreclosure, the landlord would disappear with your money.
You will have to read the law to see how it applies to you specifically. It will be under Arizona Revised Statutes.
